1. Scope of service
Orfolio is an AI-powered website builder operated by Studio Orfolio Inc., a Canadian company registered in Quebec. The platform allows users to create, design, customize, and publish professional websites using AI, ready-made templates, or custom design tools. By accessing or using Orfolio, you agree to be bound by these terms.
Orfolio is intended for lawful commercial, personal, and creative use. Prohibited uses include illegal activities, malware distribution, phishing, fraud, defamatory content, or abusive automated behavior.
2. User obligations
By using Orfolio, you agree to:
- Provide accurate, up-to-date, and complete information during registration and subscription management.
- Keep your login credentials confidential and notify us immediately of unauthorized access.
- Comply with applicable laws, including Canadian privacy law, intellectual property law, and consumer protection regulations.
- Use the platform responsibly and avoid illegal, harmful, defamatory, discriminatory, or third‑party‑rights‑violating content.
- Respect Orfolio infrastructure and refrain from reverse engineering, data scraping, or bypassing security measures.
3. Prohibited content and activities
Users are strictly prohibited from uploading, generating, or distributing:
- Illegal, fraudulent, or defamatory content, including hate speech, harassment, or threats.
- Pornographic, violent, or adult content violating community standards or Canadian law.
- Abusive automated behavior such as spam, bot traffic, or excessive API use intended to disrupt services.
- Copyrighted or IP‑protected material used without proper authorization or license.
Orfolio reserves the right to review, remove, or suspend any content or account violating these terms.
4. Limitation of liability and warranties
Orfolio is provided “as is” and “as available.” While we strive for reliability and security, we do not guarantee uninterrupted, error‑free, or fully secure access at all times.
Studio Orfolio Inc. is not responsible for:
- Loss of data, revenue, or business opportunities resulting from use or inability to use the platform.
- Damages caused by third‑party services, user‑generated content, or external AI providers integrated into Orfolio.
- Indirect, incidental, or consequential damages due to downtime, bugs, or technical failures.
Users are responsible for maintaining backups and ensuring compatibility with third‑party services they choose to integrate.
5. Account suspension and termination
Orfolio may suspend or permanently terminate accounts in the following circumstances:
- Violation of these terms or any applicable law.
- Non‑payment or fraudulent payment activity.
- Abusive or disruptive behavior toward staff, users, or Orfolio infrastructure.
- Inactivity exceeding 6 months for accounts without a subscription.
Users may request account deletion at any time by contacting rdpd@orfolio.com. Upon termination, access to hosted content and services will end and data may be deleted per our retention policy.
6. Subscription, payment, and cancellation
Orfolio offers monthly or annual billing cycles. Payments are securely processed via Stripe.
- Billing: Subscription fees are billed in advance on a recurring basis unless canceled before the next cycle.
- Auto‑renewal: Subscriptions renew automatically unless explicitly canceled by the user in account settings.
- Cancellation: Users can cancel anytime. Premium access continues until the end of the current billing period.
- Refunds: Refund eligibility is governed by our refund policy.
- Price changes: Orfolio may modify subscription pricing. Existing subscribers will be informed at least 30 days in advance.
7. Intellectual property rights
Orfolio IP: All software, designs, trademarks, templates, and AI‑generated elements provided by Orfolio remain the exclusive property of Studio Orfolio Inc. unless otherwise stated. Users receive a limited, non‑exclusive, revocable license to use these elements only within Orfolio.
User content: Users retain full ownership of the content they create, upload, or generate. By using the platform, users grant Orfolio a non‑exclusive, worldwide license to host, display, and process their content solely to provide the service.
Users are responsible for ensuring they have the necessary rights and licenses for any third‑party content (images, fonts, plugins, etc.) they integrate.
8. AI‑generated content and automated features
Orfolio uses AI to help users create websites, generate content, and receive design recommendations. AI content is produced using third‑party models such as OpenAI (GPT), Claude AI, and DeepSeek.
- User responsibility: Users are solely responsible for reviewing, editing, and validating AI‑generated content before publishing.
- No warranty: Orfolio does not guarantee the accuracy, legality, or suitability of AI‑generated content.
- Transparency: Users acknowledge that AI models may process their input data to generate personalized recommendations.
- Data processing: AI processing is performed in compliance with Law 25 and PIPEDA with explicit user consent.
9. Governing law and jurisdiction
These terms are governed by the laws of the Province of Quebec and the federal laws of Canada. Any dispute will be subject to the exclusive jurisdiction of the courts of Quebec, Canada.
By using Orfolio, you agree to submit to Quebec courts and waive any objection to venue or jurisdiction.
10. Changes to terms
Orfolio may modify or update these terms at any time. Users will be notified of significant changes by email or platform notifications.
Continued use after changes constitutes acceptance. Users who do not accept updated terms must stop using Orfolio and may request account deletion.
